On this website and in my social media accounts, I provide information about pregnancy, birth, and postpartum as well as doula support services. This information is provided solely to inform you about what your options are during these stages, to bring more awareness about what support is often required, and with the aim of helping new and expecting mothers and families to make informed decisions that will enhance their experience through the perinatal period.

There are a number of ways you may choose to work with me that are available to book or enquire about through my website. The terms and conditions in this document apply to all of my services and products unless alternative terms are explicitly provided to you.

I offer to provide support for women and their families throughout pregnancy, birth and the postnatal period, with the intention to inform, empower and support you in your choices relating to pregnancy and birth, and to help the transition you will go through after the birth of your baby to be as smooth as possible.

Why Work with Me?

It is my responsibility to keep up to date with all of the latest evidence based information and research surrounding pregnancy and birth and the postpartum period. I commit to best practice by working only within my scope as a doula and adhering to the code of conduct set out by the Doula Network Australia, which I am a member of. In order to offer my services and work with families I hold a first aid certificate, food handling and safety certificate, and have a current and valid Working With Children Check. I complete refresher courses regularly to stay up to date with the latest in best practices.

Your Responsibility

You agree to take full responsibility for your own decisions and choices, to conduct your own research and seek advice from appropriately qualified professionals for any concerning matter rather than relying solely on the generalised information that I provide you with.

Limitation of Liability

I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to providing the services again; or if I am unable to do so within a reasonable time, paying the cost of having the services supplied to you again, which shall not exceed the amount that you have paid to me. You take full responsibility for your implementation of any suggestions that I may make while providing my services. You understand that my guidance is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always check with appropriately qualified professionals before making major decisions. You agree to indemnify me against all consequences arising directly or indirectly from your choices.

Intellectual Property

The content of this website and in all my resources is protected by copyright laws and treaties around the world, with all rights reserved. You may not copy or reproduce any part of my publicly available content without my written consent.

Commercial exploitation of my content in any way that competes with my business is strictly prohibited.

Payment Terms

When you book any of my services, I will provide you with an invoice that specifies my account details. All payments are to be made by direct deposit into my account. Unless we have agreed to a payment plan, full payment is required before my services commence.

Payment plans are available should you wish to pay in instalments. Payment plans are by negotiation to ensure it is reasonable and suitable for both parties.

Should you fail to make a payment on time, I have the discretion to postpone my services until payment has been received.

You agree to pay all costs, including debt collection agency fees and solicitor’s costs, that I may incur in taking steps to recover any money that you owe to me whether or not legal proceedings are issued in relation to the debt.

Appointment Policies

Please give me at least 24 hours’ notice if you need to reschedule an appointment. If you do not give me sufficient notice you may forfeit your appointment unless due to exceptional circumstances beyond your control.

If you fail to show up to an appointment without letting me know in advance, you will forfeit that appointment and it will not be rescheduled. You will not be refunded for any appointments that you don’t turn up to without notice.

Refund Policy

I offer a pro rata refund if you choose to cancel my services before services commence. The amount refunded is based on the number of weeks you cancel before your estimated due date. Full details of withdrawals and refunds are outlined in the Client Service Agreement, which you will receive when booking my services.

Respectful Communication

I reserve the right to delete any comments on my website or social media accounts which are rude, offensive or which I deem to be unacceptable.

Dispute Resolution & Jurisdiction

If you have any concerns, issues or complaints arising out of your use of this website, my services, or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to resolve the dispute in good faith through negotiation and discussion. Please email me at info@newseasondoulacare.com.au and expect a response within 5 business days.

“We” below refers to everyone involved in the dispute. If the dispute cannot be resolved by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 80kms of each other. The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of Victoria or similar neutral authority. We agree to share all the costs of mediation equally between us. We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

If a dispute arises, we all agree that we will not engage in any public discussion about the issues, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonably be expected to unreasonably interfere with any other person’s business or personal interests.

This agreement is subject to the governing law of Victoria. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
